1. INTRODUCTION

These Conditions explain the rights, obligations and responsibilities of both Best Quality Designer Bag Store and you the Customer, in relation to the Services to be provided by Best Quality Designer Bag Store. Some words in this policy have special meanings, which are explained in Part 2 under the heading MEANING OF WORDS. Whenever these words are shown in bold type, they have these special meanings. Otherwise, they have their ordinary everyday meaning.

3. ONLINE OFFERS / IN STORE INITIAL OFFERS

All offers will be based on Best Quality Designer Bag Store's own determination of the item(s) value in reliance on the accuracy of the information you supply us. Best Quality Designer Bag Store will use its discretion to determine the item(s) value, weighing factors that may include the item(s) model, functionality, size, age and condition and whether necessary item(s) accessories have been provided by you. Your Initial Offer will be valid for fourteen (14) days. If we fail to receive your item with in fourteen (14) days you may need to open another transaction with us at which point, assuming the Item(s) is still eligible for purchase, the new offer may be different as Item(s) prices are subject to change.

4. SENDING THE HANDBAG CLINIC HQ YOUR ITEMS

When selling your bag to us, please refrain from including any extra items that were not part of the original purchase, such as bag liners, receipts or additional embellishments. Proof of purchase and receipts are disposed of to meet GDPR guidelines as they contain sensitive information. We won't assume liability for additional items, your cooperation in adhering to this policy is greatly appreciated for a smooth transaction. When packaging your item(s) be sure to include all materials included in your description, when we calculated your offer. This may include particular accessories. Failure to include any item(s) you told us about when the offer was calculated, or sending us an item(s) which does not match your original description, may impact the final value of your item(s) and may result in a revised offer.

Packing and shipping recommendations provided to you by Best Quality Designer Bag Store should be followed in order to avoid possible damage to or loss of the Item(s) in transit. Best Quality Designer Bag Store will inspect all item(s) that are received. Best Quality Designer Bag Store has the option to accept or reject the item(s), including without limitation, to reject any Item(s) not conforming to the description you provided to us, any item(s) modified in such a way that it no longer conforms to the original factory specifications, any item(s) no longer complying with applicable laws or regulations and/or any item(s) damaged or lost in transit. If Best Quality Designer Bag Store rejects the item(s) for any of these reasons, the original offer automatically expires and is rescinded. Best Quality Designer Bag Store reserves the right to revoke the original offer and provide a revised offer for the item(s) if: (a) the item(s) and/or materials are not as described,(b) the item(s) is received by Best Quality Designer Bag Store after the Delivery Period, and/or (c) Best Quality Designer Bag Store receives item(s) that are different from those identified when your offer was calculated If you are shipping your item to us internationally, the fees and custom fees are the responsibility of the sender. We will not be responsible for any Customs issues, charges or delay to any international shipping being sent to us or returned. If the item is subject to fees, these can be paid directly to the shipping company or can be removed from your agreed offer.

In the event Best Quality Designer Bag Store recalculates the offer it provided for the item(s) after it has been received and inspected, as described above, you shall have the option of accepting or rejecting the new offer. If you accept the new offer, you will be paid in normal course and in accordance with these service terms.

If you reject the offer or we are unable to accept the item, Best Quality Designer Bag Store will return the item(s) to you at the charge of £14.95 (UK Mainland only) at the address from which it was originally sent. Best Quality Designer Bag Store will give you a period of 30 days after Best Quality Designer Bag Store presents you with are calculated offer via email at the address you provided to accept or reject the new offer. Best Quality Designer Bag Store will also remind you of the outstanding new offer one or more times during the New Offer Period.

5. ASSESMENTS

Best Quality Designer Bag Store shall not be responsible for communication errors should your contact information be inaccurate or incomplete. You understand and agree that if you fail to provide us with accurate and up to date information about yourself. We will not be responsible for any misapplied payments or payments sent to a wrong address. Items must be sent with your FULL NAME, REGISTERED EMAIL ADDRESS and UNIQUE ITEM REFERENCE NUMBER included with in the package or with your free shipping label. If you fail to do so your item may be unidentifiable to our team resulting in your item being sold, destroyed or donated after 30 days of the package arriving with us. You may be required to provide proof of serial numbers and uniquely identifying details to claim your item at a later date should the original ownership be unidentifiable upon arriving with us.

Item(s) Eligibility: Best Quality Designer Bag Store determines in its sole discretion, which item(s) are eligible for purchase by or through the Best Quality Designer Bag Store Services and for which eligible item(s) Best Quality Designer Bag Store will provide an offer. Best Quality Designer Bag Store may terminate the eligibility of certain item(s) at any time and without advanced notice.

Do not submit item(s) that are non-operative or with physical damage that inhibits use. The above definitions are broad guidelines, more specific condition definitions specific to the category and or type of item(s) may be included on the Best Quality Designer Bag Store Website offer screen and serve as the effective condition definition for that item(s). Condition definitions are subject to change at Best Quality Designer Bag Store's discretion. Items not claimed in 90 days may be disposed of, donated or sold at the value of our choosing, which ever is the most sustainable way determined by our team to experts. We reserve the right to reject any item which fails to meet our condition criteria at any time. If your item is rejected due to its condition a charge of £14.95 will apply, failure to make this payment with in 90 days of notification will result in your item being sold or donated to a third party, or destroyed, the most sustainable and economical disposal method will be determined by our management team.

Best Quality Designer Bag Store only accepts fully authentic Item(s). Once received, our team of experts will go through a thorough authentication process. Our experts have multiyear experience in luxury fashion and in the brands carried by Best Quality Designer Bag Store. They are extremely knowledgeable and will find out counterfeits. If your bag is identified as Counterfeit, we reserve the right to pass this over to the required authority and NOT return the item(s) to you. All Item(s) deemed as UNAUTHENTIC will be handed to the required authority or destroyed 14 days after we have informed you the bag is unauthentic. If you would like this item returned to you there will be a charge of up to £100 + delivery fees which must be paid prior to the bag being sent back to you. IF YOU FAIL TO MAKE THE UNAUTHENTIC PAYMENT CHARGE WITH IN 14 DAYS OF NOTIFICATION YOUR ITEM WILL BE DESTROYED.

Upon receiving an offer, you have the option of accepting or rejecting that offer. Acceptance indicates you are willing to sell your item(s) to/with Best Quality Designer Bag Store at the offered price. If you do not accept Best Quality Designer Bag Store's offer or fail to respond, the specific transaction expires after 30 days. If after rejecting the offer you change your mind and want to accept the offer, you may need to open another transaction with us at which point, assuming the Item(s) is still eligible for purchase, the new offer may be different as Item(s) prices are subject to change. If you chose to reject your offer or fail to respond item will only be covered under our Liability as per clause 11 and 11a of these terms. Items not claimed in 90 days may be disposed of, donated or sold at the value of our choosing, which ever is the most sustainable way determined by our team to experts.

Please note, once an offer is accepted it cannot be changed or an alternative offer accepted. This applies to all offer types (Cash, Voucher, Consignment).

We reserve the right to destroy any physical paper work sent to us relating to your item, including receipts as these hold your personal data. We do not recommend receipts or paper work containing personal or financial details are sent with your item.

6. OFFER CANCELLATION

All Offers from Best Quality Designer Bag Store to purchase submitted Item(s) are non-binding and indicative only. Best Quality Designer Bag Store reserves the right, at its sole discretion and at any point in time to cancel any Offer or Consignment Agreement. If you have accepted an offer and change your mind prior to the Title of Property has transferred and would like to request a cancellation Best Quality Designer Bag Store reserve the right to deny this request. In the event your cancellation request is accepted you will incur a charge of a minimum of £14.95, this will increase depending on where in the Buying process up to the value of £50- £100, plus any charges incurred for any cleaning and restorative work carried out on your item and the full retail value. Best Quality Designer Bag Store may terminate the eligibility of your consignment agreement at any time and without advanced notice.

7. CONSIGNMENT TERMS

Details of your specific Consignment terms will be provided to you as part of your Assessment. Until these are returned to us signed your item(s) will be considered as still under Assessment and Assessment Terms and Conditions will apply.

Once accepted and your item(s) is available for sale with us you are insured up to the value the amount listed in your consignment agreement minus our consignment fee.

In the event your consignment agreement ends and you have not notified us that you would like your item to be returned, your consignment agreement will automatically renew on a 30 day term. In the event you or we do not intend to renew the agreement you will be notified a delivery will then be arranged and a delivery charge may be incurred. If you wish to terminate the consignment agreement at any point your item will only be removed from sale once the required fees mentioned in section 6 and/or 7 are made. It may take up to 14 days for us to process your request. Failure to pay the required fees will result in your item remaining under your standard consignment terms. You will receive regular invitations to include your item in promotional activities or reduce your item should it fail to sell with in the initial 3 month consignment period. If you fail to respond to these with in one month of receiving this invitation Best Quality Designer Bag Store will hold autonomy over your pricing. Upon sale of your item you will receive a reduced consignment amount in line with our standard percentage commission. Failure to respond to any of our correspondence regarding your item for over 12 months may result in your item being disposed, donated or sold at the value of our choosing, which ever is the most sustainable way determined by our team to experts.

The Sale of your item will be subject to a 10 working day cooling off period starting when your item is delivered to a potential buyer, should the order be cancelled by either ourselves or the clients, or returned to us with in those 10 days this will not constitute as a sale. After the 10 working day cooling off period has lapsed and your item has not been returned or the order cancelled you will be contacted to organise payment. It can take up to 30 days to receive your payment

In the event your bag/s are on consignment and our selling price is £7000 and above you will only be eligible for payment until the returns period has lapsed and the bag has NOT been returned. Only the consignee can discuss their item with us unless full written consent from the email address attached to the item reference number is provided. If you wish to terminate the agreement after 90 days a delivery charge will apply. Only the legal owner of the bag can discuss their item with us unless full written consent from the email address attached to the item reference number is provided

8. PAYMENTS

Payments made to clients who accepted CONSIGNMENT offers are made via direct bank transfer upon a successful sale. A successful sale is constituted by the Terms detailed in Section 7. More information relating to Consignment Offers can be found in your Consignment Agreement, our FAQs or Section 7 of our Terms and Conditions. As in Section 7, after the 10 working day cooling off period has lapsed and your item has not been returned or the order cancelled you will be contacted to organise payment. It can take up to 30 days to receive your payment from receipt of your account details. Payments made to clients who accepted CASH offers are made via direct bank transfer not in cash. This is actioned in 3-5 working days from when we have completed the final assessment of your item(s) at our Head Office however we reserve the right to extend this during busy periods. Your item(s) is owned solely by Best Quality Designer Bag Store from point of payment. All payments made to clients are actioned via bank transfer only. In all cases clients are contacted directly to ascertain their account details. The client is responsible for providing the correct account details to Best Quality Designer Bag Store. Best Quality Designer Bag Store are not liable should incorrect details be provided. All details must be submitted in written format by the customer/email address registered against the item/d reference number. In any event you fail to provide your account details on request or provide incorrect account details, you have 12 months to inform us of the correct details so successful payment can be made. If these are not provided within 12 months, Best Quality Designer Bag Store is no longer liable to make this payment to you but can retain your item(s).

9. PROCESSING AND RESTORATIVE WORK

Best Quality Designer Bag Store are able to carry out any cleaning and restorative work required to your item(s) prior to the item being available for sale or at any point while listed for sale with us.

Best Quality Designer Bag Store may increase the selling price of your bag at its discretion without informing you. For consignment item(s) you will still receive the percentage listed with in your specific Consignment terms minus the cost of the repairs carried out. 10. TITLE TO PROPERTY

Cash and Store Voucher - You will continue to own and have title to each item(s) until the BACS payment has been processed or your E-Wallet has been updated with the appropriate funds.

Consignment - You will continue to own and have title to each item(s) of Property until that Item(s) is "Sold". All Item(s) will be considered Sold when:

it is sold by Best Quality Designer Bag Store to a customer and not returned to Best Quality Designer Bag Store within the period specified in Best Quality Designer Bag Store's then-current Return Policy (https://buyluxurybag.cn/terms-of-service-sales); or

it is lost, stolen, damaged, or destroyed while in Best Quality Designer Bag Store's possession.

11. TIMESCALES

The length of time required to properly carry out Our Assessment can vary from a couple of days to a maximum two weeks.

The length of time required to properly carry out processing and cleaning/restorative work vary from two (2) to fourteen (14) days. The variation is down to the type of service required.

11. LIABILITY

Whilst your Item(s) is in our care you are insured up to the Full Item Value, Depreciated Value or our Maximum Liability, whichever is the lesser, minus the cost of our Services. This is to cover you should your Item(s) become lost, stolen or damaged beyond repair.

Items in our care are:

Any Item currently having our services carried out, or waiting for our services to be carried out. Any Item waiting for You to collect from Us will be in our care for a maximum period of 90 days. Any Item your leave in our concessions or post to us will be held in our care for a maximum period of 90 days and will only be deemed in our care when we acknowledge receiving it. If your item is held with us under consignment, you will receive the amount due to be paid to you upon the sale of your item/s, the adjusted amount following the reduction of your item/s or our maximum liability, whichever is the lesser.

11 (a) EXCLUSION TO LIABILITY

Customers using our UPS Ship for Free Drop Off service to have an item(s) sent to us via a drop off location are only insured when the item arrives with us and we have verified the contents of the package, authenticity and condition of your item. All parcels being sent via this method are covered by UPS Standard Liability which is £60 per parcel. Customer using our Free Royal Mail Drop Off service to have an item(s) sent to us via a drop off location are only insured when the item arrives with us and we have verified the contents of the package, authenticity and condition of your item. All parcels being sent via this method are covered by Royal Mail Standard Liability which is £150 per parcel. If you DO NOT collect or accept delivery of Your item(s) within 21 days of being notified by Us that it is ready to collect/deliver we will not be held responsible in any way for your item(s). The 21 day period for item(s) left in our shop(s)/ Head Quarters or posted to us will commence on the day you are informed the item(s) ready for delivery or collection and we will not be held responsible in any way for your item(s)thereafter. The Handbag Clinic reserve the right to transfer your item(s) into storage if not collected with in 21 days of being notified your item(s) is ready for collection or you fail to respond to our communication to complete your offer or engage with our correspondence regarding your consigned item/s. If your item(s) is placed into storage a charge of a minimum of £14.95 will be incurred. Items not claimed in 90 days may be disposed of, donated or sold at the value of our choosing, which ever is the most sustainable way determined by our team to experts. Only the legal owner of the bag can discuss their item with us unless full written consent from the email address attached to the item reference number is provided Branded dustbags, care cards and authenticity cards do not increase or decrease the financial value of a particular item, we will not be held liable for these items being returned to you in the event your item is rejected, or your consignment period ends or is terminated and the item returned to you. We are not liable for any item which has not passed our authenticity or condition requirements.

12. ADVERTISING AND SOCIAL MEDIA

Accepting an offer with Best Quality Designer Bag Store provides Handbag Clinic with full consent to use your item for in any of its advertising campaigns, social media or competition giveaways. We reserve the right to remove your item from our online store to feature in social media, live shopping, personal shopping and to view in any concessions and pop up's. Your item will remain for sale through these channels while not visible on our eCommerce store.
